1. Pet Policy

Dogs are welcome with prior approval and the applicable pet fee.

• 1 dog: $50 per stay
• 2 dogs: $75 per stay
• Maximum of 2 dogs per dome

Dogs must be disclosed when booking and must be house-trained, supervised, and under control at all times. Dogs must be leashed or otherwise securely controlled outdoors, and guests are responsible for promptly picking up and properly disposing of pet waste.

Dogs are not permitted on beds, bedding, or furniture.

Dogs may never be left unattended inside a dome or elsewhere on Kirby Land. The domes do not have air conditioning and may become dangerously hot.

Dogs may accompany their owners into an individual private bathhouse room when under control but are not permitted in the shower itself or on bathhouse furnishings. Guests must clean up any pet-related mess.

Kirby Land is a natural, wooded property where wildlife may be present. Guests must keep dogs under control and must not allow them to chase, approach, harass, or interact with wildlife.

Wildlife & Pet Safety: Kirby Land is a natural, wooded property where wildlife may be present, including potentially dangerous or unpredictable animals. Guests are responsible for supervising and controlling their dogs at all times and for taking reasonable precautions to protect their pets from wildlife encounters. To the fullest extent permitted by law, Kirby Luxury Stays LLC and the property owners are not responsible for injury, illness, loss, or death of a guest's pet resulting from encounters with wildlife or other naturally occurring hazards on the property.

The regular pet fee covers normal approved-pet cleaning. Indoor urination, defecation, vomiting, soiling, or other excessive pet-related cleaning may result in a minimum additional cleaning charge of $100. Guests may also be responsible for the actual cost of additional cleaning, repair, or replacement if those costs exceed $100.

Guests are responsible for the behavior of their dogs and for injury or damage caused by their dogs.

This Pet Policy and its pet fees do not apply to qualifying service animals, which are accommodated in accordance with applicable law.

2. Reservations, Payment & Cancellation

Reservations & Payment

A reservation is confirmed when the booking process has been completed and the required payment has been received.

Full payment is required at the time of booking unless otherwise stated by Kirby Luxury Stays or the booking platform used to make the reservation.

Rates, taxes, pet fees, and other selected charges are displayed during the booking process.

The person making the reservation is considered the Primary Guest and is responsible for the reservation, payment, and compliance of all members of the party with Kirby Luxury Stays policies.

Only registered overnight guests are permitted unless prior approval is received from Kirby Luxury Stays.

Minimum booking age: The Primary Guest must be at least 21 years old and must be present for the entire duration of the stay. Reservations may not be made on behalf of guests under age 21 who will be staying without the Primary Guest.

Cancellation & Refunds

• 14 or more days before check-in: 100% refund
• 7–13 days before check-in: 50% refund
• Less than 7 days before check-in: No refund
• No-shows or early departures: No refund

No separate cancellation fee is charged.

Weather

Normal seasonal weather, including rain, heat, cold, and storms, does not override the standard cancellation policy.

If Kirby Luxury Stays determines that conditions at the property make a stay unsafe and cancels the reservation, the guest will receive a refund for affected unused nights or may reschedule subject to availability.

3. Occupancy, Visitors & Gatherings

Each dome has a maximum occupancy of 4 overnight guests.

All overnight guests must be included on the reservation. The Primary Guest is responsible for the conduct of all members of the party and any approved visitors.

Unregistered overnight guests are not permitted without prior approval.

Day visitors are not permitted without prior approval from Kirby Luxury Stays.

Parties, large gatherings, commercial events, and organized events are not permitted unless approved in advance by Kirby Luxury Stays.

4. Off-Grid Property & Amenities

Kirby Luxury Stays is an off-grid glamping property located in a natural, wooded setting. It is not a traditional hotel. Guests should expect the sights, sounds, weather, insects, wildlife, terrain, and other conditions associated with a natural outdoor environment.

The domes are solar-powered. The solar system is intended to support interior lighting, device charging, a small refrigerator, and a coffee maker. Guests should conserve electricity, and availability may occasionally be affected by weather or system capacity.

The domes do not have air conditioning or heat. Temperatures may vary significantly with outdoor conditions, and guests should plan and dress according to the forecast.

A separate shared bathhouse provides four individually private rooms: two shower rooms and two toilet rooms.

The bathhouse is approximately a 2-minute walk from Dome 1 and approximately a 4-minute walk from Dome 2.

Running water is available at the bathhouse for washing, showering, and everyday use. Guests should bring their own drinking water for their stay.

Wi-Fi access is available. Because Kirby Land is a rural, off-grid property, uninterrupted internet or cellular service cannot be guaranteed.

5. Fire & Outdoor Safety

Fires are permitted only in designated fire pits and only when conditions and Kirby Luxury Stays permit.

Fires must never be left unattended. Guests must maintain fires at a safe size and fully extinguish them before leaving the area or going to sleep.

Gasoline, unauthorized accelerants, and fireworks are prohibited on Kirby Land.

Children must be appropriately supervised around fire pits, grills, hot surfaces, and outdoor cooking areas.

Kirby Luxury Stays may temporarily prohibit or restrict fires because of dry conditions, weather, local restrictions, or other safety concerns.

Guests are responsible for safely operating grills and fire-pit cooking equipment and must not leave hot coals, grills, or cooking fires unattended.

6. Property Care, Damage & Cleaning

Guests must treat the domes, bathhouse, furnishings, equipment, outdoor areas, trails, and other property with reasonable care.

Guests are financially responsible for damage caused by themselves, members of their party, approved visitors, or pets beyond normal wear and tear. The Primary Guest may be charged the reasonable cost to clean, repair, or replace damaged or missing property, including furnishings, equipment, fixtures, and other Kirby Luxury Stays property.

If an item cannot reasonably be repaired, the guest may be charged the reasonable replacement cost.

Guests should leave the dome and surrounding area reasonably clean, dispose of trash properly, and secure food and food waste.

Damage, breakage, spills, accidents, or other property issues should be reported to Kirby Luxury Stays as soon as reasonably possible.

7. Smoking, Vaping & Open Flames

Smoking and vaping are prohibited inside the domes, bathhouse, and other enclosed structures.

Smoking and vaping are permitted outdoors only and must be conducted cautiously, particularly during dry conditions. All smoking materials must be fully extinguished.

All cigarette butts, cigar remnants, packaging, vaping materials, and related waste must be picked up and properly disposed of. Nothing may be discarded on the ground, in fire pits, on trails, or elsewhere on Kirby Land.

Candles, incense, fireworks, and unauthorized open flames are prohibited inside the domes and other enclosed structures.

Guests may be responsible for reasonable cleaning, deodorizing, repair, or replacement costs resulting from violations of this policy.

8. Alcohol, Illegal Activity & Disturbances

Guests of legal drinking age may consume alcohol responsibly.

Illegal activity, unlawful drug use, dangerous or reckless behavior, and excessive disturbances are prohibited.

Guests must respect other guests and neighboring properties. Excessive noise, disruptive behavior, or unsafe conduct is prohibited.

Guests must not drive, tend a fire, or participate in activities requiring coordination or judgment while impaired.

Serious or repeated violations may result in termination of the stay in accordance with applicable law and the reservation terms.

Quiet hours are from 10:00 PM to 8:00 AM.

During quiet hours, voices, music, and other noise must not disturb other guests or neighboring properties. Outdoor speakers and amplified music must be kept at reasonable levels and may not be used during quiet hours.

9. Parking & Vehicles

Guests may drive directly to their assigned dome or campsite upon arrival. One vehicle may remain parked in the designated area at the guest's campsite. Additional vehicles must be parked in the designated main parking area.

Although portions of Kirby Land's trail system may be wide enough to accommodate vehicles, guest vehicle use is limited to traveling directly to and from the assigned campsite and designated parking areas. Recreational or unnecessary driving on the trails or around the property is not permitted.

Kirby Land's trails and outdoor areas are used by guests for walking and recreation. All drivers must proceed slowly and cautiously, watch for pedestrians, and follow posted signs or instructions.

Vehicles must not be driven into wooded or other areas not intended for vehicle access.

Guests are responsible for their vehicles and personal belongings left inside them.

10. Children & Supervision

Children are welcome at Kirby Luxury Stays. Parents, legal guardians, and responsible adults are responsible for the supervision and safety of minors in their party at all times.

Kirby Land is a natural, wooded property with trails, wildlife, uneven terrain, fire pits, grills, recreational activities, and vehicle-access areas. Children must be appropriately supervised, particularly around these areas and activities.

Children must not be left unattended at the domes, bathhouse, fire pits, trails, or elsewhere on Kirby Land.

The responsible adult must ensure that minors follow all Kirby Luxury Stays property rules and safety instructions.

11. Personal Property & Belongings

Guests are responsible for securing and protecting their personal belongings, including items left inside the domes, vehicles, bathhouse, and outdoor areas.

To the fullest extent permitted by law, Kirby Luxury Stays LLC and the property owners are not responsible for loss, theft, or damage to a guest's personal property resulting from circumstances outside their reasonable control.

Guests should not leave valuables unattended in shared or outdoor areas.

12. Outdoor Environment & Assumption of Risk

Kirby Luxury Stays is located on a natural, wooded property. Guests should expect conditions commonly associated with outdoor and wooded environments, including uneven or changing terrain, tree roots, rocks, mud, wet or slippery surfaces, limited nighttime lighting, insects, wildlife, falling branches, and changing weather conditions.

Guests are responsible for using reasonable care while walking the property, trails, campsites, bathhouse areas, and other outdoor spaces and for choosing activities appropriate for their abilities and the conditions.

Outdoor lodging and recreation involve inherent risks that cannot be completely eliminated, including slips, trips, falls, sprains, strains, and other injuries associated with walking or participating in activities in a natural outdoor environment. Guests voluntarily assume the ordinary and inherent risks associated with their stay and use of the property, to the fullest extent permitted by law.

Guests must follow posted signs, property rules, and reasonable safety instructions from Kirby Luxury Stays.

13. Wildlife & Natural Conditions

Kirby Land is a natural, wooded property where wildlife, insects, and other naturally occurring conditions may be present anywhere on or around the property at any time.

Wildlife presence cannot be predicted or controlled. Guests must not feed, approach, capture, chase, provoke, or intentionally disturb wildlife and should maintain a safe distance from any wild animal encountered on the property.

Food, pet food, and trash must be properly secured and should not be left outdoors where they may attract wildlife. Children and pets must be appropriately supervised and controlled.

Guests should promptly notify Kirby Luxury Stays of any wildlife situation they believe presents an immediate safety concern.

To the fullest extent permitted by law, guests voluntarily assume the ordinary and inherent risks associated with wildlife encounters and other naturally occurring conditions of a wooded outdoor property.

14. Rule Violations & Termination of Stay

Guests are expected to follow Kirby Luxury Stays property rules, safety requirements, and reasonable instructions from management during their stay.

Serious or repeated violations of property rules may result in termination of the stay, including but not limited to dangerous or reckless conduct, unauthorized overnight guests or gatherings, intentional or significant property damage, illegal activity, excessive disturbances, or conduct that places people, pets, property, or wildlife at risk.

When circumstances reasonably allow, Kirby Luxury Stays may first ask the guest to correct the issue. However, conduct presenting an immediate safety concern or serious violation may require immediate action.

If a stay is terminated because of a guest's serious or repeated violation of property rules, any refund will be determined in accordance with the reservation terms and applicable law.

Guests remain responsible for reasonable cleaning, repair, replacement, or other charges resulting from damage or violations for which they are responsible.

15. Liability Waiver & Guest Acknowledgment

Kirby Luxury Stays is an outdoor, off-grid glamping property. As a condition of staying at the property, the Primary Guest and other adult guests, as applicable, may be required to complete and electronically sign the Kirby Luxury Stays Rental Agreement and/or Liability Waiver before arrival.

Guests are responsible for reviewing the applicable agreements and property rules and for providing accurate information regarding the members of their party.

Completion of a reservation does not eliminate or replace any separate acknowledgment, agreement, or waiver required by Kirby Luxury Stays before the stay.

16. Service Animals

Kirby Luxury Stays welcomes guests with service animals in accordance with applicable federal and Michigan law.

Qualifying service animals are not considered pets and are not subject to Kirby Luxury Stays pet fees. Service animals must remain under the control of their handler and must be housebroken, as required by applicable law.

Kirby Luxury Stays will not require certification, registration, identification, or medical documentation for a service animal. When permitted by law and when the service provided by the animal is not readily apparent, Kirby Luxury Stays may ask the limited questions allowed by applicable law to determine whether an animal qualifies as a service animal.

Guests remain responsible for damage caused by their service animal to the same extent that guests are responsible for damage they cause themselves.

Service animals in training will be accommodated as required by Michigan law.

Emotional support, comfort, or companion animals that do not qualify as service animals under applicable law are subject to Kirby Luxury Stays' regular Pet Policy, including applicable pet fees.

17. Check-In & Check-Out

Check-in begins at 3:00 PM. Guests may arrive any time after 3:00 PM on their scheduled arrival date.

Check-out is by 11:00 AM on the scheduled departure date.

Guests should follow the arrival, parking, and access instructions provided by Kirby Luxury Stays and respect the check-in and check-out times so the property can be properly prepared between stays.

Early check-in or late check-out is not guaranteed and must be approved in advance by Kirby Luxury Stays.

18. Lost & Found

Guests are responsible for checking their dome, bathhouse areas, vehicles, and outdoor spaces for personal belongings before departure.

If an item is found after checkout, Kirby Luxury Stays will make reasonable efforts to identify and contact the owner when possible.

Lost items may be returned by mail or another available shipping service at the guest's expense. The guest is responsible for all shipping and handling costs associated with returning the item.

Kirby Luxury Stays cannot guarantee the recovery of lost or forgotten items and is not responsible for items that are lost, misplaced, or left behind.

Found items will be held for up to 60 days after the guest's checkout date. After 60 days, unclaimed items may be donated, discarded, or otherwise disposed of at the discretion of Kirby Luxury Stays.

19. Management, Safety & Property Restrictions

Kirby Luxury Stays may temporarily restrict access to trails, recreational areas, fire pits, or other portions of Kirby Land when reasonably necessary for guest safety, weather conditions, maintenance, wildlife activity, fire risk, or other property conditions.

Guests must follow posted signs, temporary closures, safety notices, and reasonable instructions provided by Kirby Luxury Stays.

Guests must not enter areas that have been closed or restricted or interfere with safety barriers, signs, equipment, or property maintenance.

Temporary restrictions or closures made for safety or property-management purposes do not automatically qualify for a refund. If Kirby Luxury Stays determines that conditions make the booked accommodation itself unsafe or unavailable and cancels the stay, the cancellation and weather provisions of these Terms & Policies will apply.

20. Governing Law & Severability

These Terms & Policies are governed by the laws of the State of Michigan.

If any provision of these Terms & Policies is determined to be invalid or unenforceable under applicable law, that provision will be limited or modified to the extent necessary, and the remaining provisions will continue in effect.

Nothing in these Terms & Policies is intended to waive or limit any right or obligation that cannot lawfully be waived or limited under applicable law.
